Drink-driving and traffic

DEFENCE IN ROAD TRAFFIC OFFENCES IN ALMERÍA

An alcohol check or an accident can turn into criminal proceedings within hours. Most of these cases are dealt with as a fast-track trial, so it is advisable to speak to a criminal lawyer before the court summons.

Offences we defend

  • Driving under the influence of alcohol or drugs or with a breath alcohol level above 0.60 mg/l (art. 379.2 of the Criminal Code).
  • Refusing to take alcohol or drug tests (art. 383).
  • Speeding more than 60 km/h over the limit in urban areas or 80 km/h on interurban roads (art. 379.1).
  • Driving without a licence, with a withdrawn licence or after losing all points (art. 384).
  • Reckless driving and driving with disregard for the lives of others (arts. 380 and 381).

What is at stake

In addition to a fine or community service, a drink-driving conviction always carries a driving ban of one to four years and leaves a criminal record. For those who drive for work, the consequences can be very serious.

Plead guilty or defend yourself?

In a fast-track trial, a guilty plea with a one-third reduction of the sentence is usually offered. Sometimes it is the best option, but not always. Before accepting it, we review the police report: the calibration of the breathalyser, the interval between the two tests, the information on your rights or the possibility of a blood test. If there is a defence, we go to trial.
